By accessing and using the Nexfly mobile application and website (collectively, the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Nexfly is an on-demand home and lifestyle service platform that connects users with verified service providers for various services including but not limited to:

  • Pooja services and pandit booking
  • Personal beauty and salon services
  • Plumbing and electrical repairs
  • House cleaning and domestic help
  • Other home and lifestyle services

3. User Registration and Account

3.1 Account Creation

To use our services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Service Booking and Cancellation

4.1 Booking Services

Services can be booked through our mobile application. All bookings are subject to service provider availability and our acceptance.

4.2 Cancellation Policy

  • Cancellations made 2 hours or more before the scheduled service time: No charge
  • Cancellations made within 2 hours of the scheduled service time: 20% cancellation fee
  • No-shows: Full service charge

5. Payment Terms

5.1 Payment Methods

We accept various payment methods including credit/debit cards, UPI, digital wallets, and cash payments. All payments are processed securely through our payment partners.

5.2 Pricing

Service prices are displayed during booking and are inclusive of all applicable taxes. Prices may vary based on location, service type, and time of booking.

5.3 Refunds

Refunds will be processed according to our refund policy. Valid refund requests will be processed within 5-7 business days.

6. Service Provider Standards

6.1 Verification

All service providers undergo background verification, skill assessment, and training before joining our platform.

6.2 Service Quality

Service providers are expected to maintain high standards of professionalism, punctuality, and service quality. Users can rate and review services after completion.

7. User Responsibilities

  • Provide accurate and complete information during booking
  • Ensure a safe and accessible environment for service providers
  • Treat service providers with respect and courtesy
  • Pay for services as agreed upon
  • Report any issues or concerns immediately

8. Safety and Security

8.1 Safety Measures

We implement various safety measures including background verification, real-time tracking, and 24/7 customer support. However, users should exercise reasonable caution.

8.2 Insurance

All services are covered by comprehensive insurance. Users are advised to report any incidents immediately for insurance processing.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your personal information.

10. Prohibited Activities

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Harass, abuse, or harm service providers
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Provide false or misleading information
  • Use the Service to solicit business from service providers outside our platform

11. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Nexfly and its licensors. The Service is protected by copyright, trademark, and other laws.

12. Limitation of Liability

In no event shall Nexfly, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

13. Indemnification

You agree to defend, indemnify, and hold harmless Nexfly and its licensors and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms.

14. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

15. Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

19. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and Nexfly regarding the use of the Service, superseding any prior agreements between you and Nexfly relating to your use of the Service.
